Altus City Council to discuss legal matters in executive session Tuesday

During the regular meeting of the Municipal Trust Authority on Tuesday, in executive session, Councilmembers will discuss confidential communications between the governing body and its legal counsel relating to two pending court cases, Oklahoma Industrial Finance Authority vs. The Altus Municipal Authority, and the First National Bank in Altus vs. Quartz Mountain Aerospace, the Altus Municipal Authority and the Altus/Southwest Area Economic Development Corporation.

If the public body, with the advice of its legal counsel, determines that disclosure will seriously impair the ability of the public body to conduct the pending litigation in the public interest, and in open session, vote to authorize the chairman to sign and return on behalf of the AMS, the waiver of conflict between the AMA and the EDC, arising from lending-related transactions between the AMA and the DEC, as prepared by the AMA's special council, Charlie Geister, of the law firm of Hartzog Conger Cason & Neville, in his Oct. 19, 2009 letter, who will be representing both the AMA and the EDC in this pending litigation, as authorized by Title 25 O.S.A. Section 307 (B) (4).

In other MTA business, the Council will review, discuss and vote to authorize the write-off of uncollectible utility accounts from 2005 in the amount of $30,908.65, and discuss T-hangar construction items.

The regular meeting of the City Council will follow the MTA meeting and will include purchase orders and claims under the consent agenda, as well as amending the FY 2009-2010 annual budget by $31,200 for a community warning system, and Altus Municipal Authority financing.

In executive session, the Council will discuss a pending tort claim filed by Dee Guthrie for medical and other damages, a pending tort claim in the amount of $276.52 filed by Courtney Creveton for damage to her automobile. Also in executive session, council will discuss the annual evaluation for the Electric Superintendent.
