Calvert is the fourth defendant involved in the Phan case. She plead guilty and was sentenced Wednesday in Jackson County District Court. and was sentenced by District Judge Clark Huey to 20 years with all but 10 suspended on both counts, to run concurrently.
Prosecutors say that Calvert and co-defendant Dominique Lindsey, 23, drove Phan and two of his friends from an Altus nightclub to an apartment complex where the victims were ambushed and robbed by co-defendants Marquis Dorsey, 26; Sedrick Sanders, 33; and Patrick Robinson, 29.
Sanders was the one who was said to have shot and killed Phan before all five defendants went to a party on the other side of town.
Pleas of guilty were entered Tuesday in Jackson County District Court by Lindsey and Dorsey, both of Altus. Lindsey pled guilty to one count of Conspiracy to Commit Robbery with a Dangerous Weapon and was sentenced to 10 years, all suspended but 2 years.
Dorsey pled guilty to one count of Accessory After the Fact to the Crime of Robbery with a Dangerous Weapon and was sentenced to 10 years, all suspended but 2 years.
The pleas by Lindsey and Dorsey follow an earlier plea on Sept. 10, 2010, by Sanders of Altus, who was the defendant that fired the fatal shot at Phan. Sanders pled guilty to Felony Murder and Conspiracy to Commit Robbery with a Dangerous Weapon and was sentenced to life and 10 years, to run concurrent.
The remaining defendant in the case, Patrick Robinson, is currently charged with Felony Murder and Conspiracy to Commit Robbery with a Dangerous Weapon, and is awaiting a jury trial. No date for the trial has been set.
