Probation, parole recommended for former Headrick town clerk/treasurer

ALTUS - Probation and parole officials have recommended that the former Headrick town clerk/treasurer be given a term of probation and ordered to pay restitution on two counts of embezzlement by officer and one count of embezzlement when she appears before District Judge Richard B. Darby on Friday for sentencing.

Robbin Gardner, 36, who resides with her Air Force husband and five children at Minot Air Force Base in North Dakota, pleaded no contest to the charges June 29 and was found guilty. Gardner was Headrick's town clerk/treasurer from April 2003 to December 2005.

According to an affidavit of probable cause for arrest filed in September 2005 in District Court, a review of a special audit report of the town of Headrick covering the period from January 2003 through December 2004 reflects that between Feb. 27, 2003, and Dec. 27, 2004, Gardner falsified the books and account records for her personal home utility account and farm utility account by marking them as paid by cash or check in the amount of $2,540.95 when no cash or checks were received by the town for those accounts.

Also, the audit reflects that between May 6, 2003, and Jan. 3, 2005, Gardner received $6,233.25 in cash payments and did not deposit the cash with the Jackson County Treasurer for use by the town of Headrick.

A pre-sentence investigation by probation and parole officials turned up no prior criminal record for Gardner.

Sentencing is set for 9 a.m. on Friday.
