Bobby Lee Davoult, 22, of 1401 Hemlock, is locked up under a bond of $100,000 following his arrest on a warrant issued Sept. 1 charging him with first degree rape by a person over 18 upon a person under 14; forcible sodomy by a person over 18 upon a person under 14; willfully or maliciously engaging in child abuse; domestic abuse; and willfully causing, encouraging or contributing to the deprivation of a minor.
A preliminary hearing conference in the case was set for Tuesday before Special District Judge Suzanne Mollison.
According to the affidavit for issuance of arrest warrant, on Nov. 22, 2005, Altus Police Detective David Doughty was notified by a state Department of Human Services child welfare worker that she had interviewed the alleged victim, an 8-year-old girl, but that the girl did not disclose anything that particular day. However, the girl was removed from her father's custody for other reasons and placed into DHS custody.
After a short time with a foster family, the affidavit states, the young girl disclosed sexual assault to the family, and upon a second interview the girl told the child welfare worker that Davoult, then 21, had had sex with her while he resided with her and her father at 511 N. Navajoe in September and October 2005 and at the Hemlock Street address during November 2005.
The girl disclosed that Davoult slept in the room that she shared with her father on Hemlock and that the man had sex with her every night. She said that the last time it happened was the day before she was removed from the home and placed into DHS custody.
The girl went on to say that the same thing happened, some 20 to 30 times, at the Navajoe Street address during the day, when Davoult was babysitting her.
At the Hemlock Street address, the girl stated, if she resisted, Davoult “would hit her head against the bed” and “would often make a slashing motion with his finger across his neck.” She said that she had not told anyone because she was afraid of what both her father and Davoult would do.
The girl went on to say that she missed school because Davoult had told her to act like she was sick and that Davoult had talked her father into letting her miss school. The girl was absent 24 out of 56 school days, plus an additional eight days after a warning was issued to her father.
Davoult, who was interviewed by Doughty on Feb. 28 of this year, denied ever having inappropriately touched or had sex with the girl but refused when asked if he would submit to a polygraph exam.
According to the affidavit, four known reports show Davoult having an “un-natural interest” in an 11-year-old girl and a 15-year-old girl.
State Department of Correction records show that Davoult had previously been convicted in March 2003 for second degree burglary, for which he served two years of probation; received a two year deferred conviction for second degree burglary in August 2003; and received a second degree burglary conviction in March 2004, for which he was incarcerated for about four months.
