The prosecution holds that Michelle Calvert and Dominique Lindsey set up Phan and his friends, Dung Phan, and Han Dang for a robbery, while they shared drinks at Scooters. The women allegedly drove Phan and friends to the Ridgecrest apartments in Altus, where the crime was to take place. During the robbery, for which Sanders, Marquis Dorsey, and Patrick Robinson are charged, Phan was stabbed and fatally shot. The defendants scattered and split up money later, according to the prosecution. Sanders fled to Dallas where he was arrested in the case, July 1, 2009.
Dominique Lindsey, the only defendant who is not held on the murder charge, but on robbery with a dangerous weapon and conspiracy to commit the robbery, would appear on Friday morning. A pre-trial hearing for Sanders was scheduled with Patrick Robinson and Michelle Calvert later Friday, with Judge Clark Huey.
According to David Thomas of the prosecution team, plea agreements have yet to been made. If and when plea agreements are completed with co-defendants, they will be revealed at that date. He also said Dorsey, has already waived his right to a speedy trial in the matter.
