The first was against Jeremy Kendall, 32, of Mangum, who was charged with first-degree manslaughter in the January accident that killed Tommy Marshall, 63, of Bridgeport, Texas.
According to the initial accident report filed by the Oklahoma Highway Patrol, Kendall was driving east on a county road one mile north of Reed on Man. 9 when he T-boned Marshall, who was traveling north on an intersecting road. Marshall was pronounced dead at the scene.
In the other case, Andrew Figueroa, 20, a soldier at Fort Sill, has been charged with second-degree murder after selling the drug Ectasy to Amanda Franklin, 27, of Mangum, just a few hours before her death on April 16, 2009. According to court documents Figueroa knew Franklin was taking a prescription diet pill that sped up her heart rate significantly. The next day Franklin went into cardiac arrest and died.
According to the toxicology report, the main component of Ectasy, MDMA, as well as the diet pill, was found in her bloodstream. Figueroa confessed to selling her the pills and led authorities to a stash of pills and marijuana he had stashed at an abandoned home.
Figueroa was arrested the day Franklin died on possession and distribution charges. He plead guilty in October 2009. He was also charged with misdemeanor marijuana possession in February, but has yet to enter a plea on that charge.
In Monday’s court filing, the Assistant District Attorney wrote that Figueroa was aware that Franklin was on prescription medication and that he acted “with contemptuous and reckless disregard of” her life and safety.
If convicted, Figueroa could face 10 years to life in prison.
